1. General provisions
These Terms set out the rules for using the Content AI service available at content-ai.net and app.content-ai.net (the Service). They are the terms for services provided by electronic means.
The service provider is Marcin Przybylski, address: Wojewódzka 37A, 05-504 Złotokłos, email: kontakt@content-ai.net, telephone: +48 601 803 444 (the Provider).
The Provider is a natural person. The Provider sells within an activity that does not require registration in the Polish business register (Article 5(1) of the Polish Entrepreneurs' Law) and is exempt from VAT.
These Terms are available free of charge before the contract is concluded at https://app.content-ai.net/dokumenty/regulamin?lang=en. They can be downloaded as a text file, saved as a PDF with the print command of your browser, and printed.
2. Definitions
App: the Content AI web application at app.content-ai.net.
Account: the User's individual account in the App.
User: a natural person aged 18 or over, a legal person or an organisational unit that has concluded an Account agreement with the Provider.
Consumer: a User who is a natural person concluding a contract not directly related to their business or profession.
Sole trader with consumer rights: a natural person concluding a contract directly related to their business where the contract is not of a professional nature for them. They have the rights described in sections 9 and 11 on the terms applicable to Consumers.
Plan: the scope of App features and limits described in the Price List (https://content-ai.net/en/#cennik): Free, Standard and Premium.
Subscription: a paid contract for access to the Standard or Premium Plan, concluded for monthly billing periods that renew automatically.
AI Provider: an external provider of artificial intelligence models: Anthropic (text), OpenAI (images, speech, transcription) and ElevenLabs (speech).
API Key: the User's own access key to the services of an AI Provider.
User Content: data, texts, documents, recordings and settings entered by the User.
Outputs: texts, images, recordings and other content generated in the App using artificial intelligence.
Knowledge Base: the feature for storing the User's documents on the Provider's server to use them when generating Outputs.
3. Types and scope of services
The Provider provides the following services by electronic means: (a) maintaining the Account, (b) making the App available for creating, assessing, editing, exporting and publishing content (articles, SEO, AIO, AEO and GEO scores, fact and link checks, images, voice recordings, transcriptions, publishing to WordPress and Drupal), (c) the Knowledge Base, (d) information on content-ai.net.
Features and limits depend on the Plan and are described in the Price List. The Free Plan includes a one-time limit of 3 articles, requires no card details and does not turn into a Subscription automatically.
Generating content on a self-created Account requires the User's API Key: Anthropic for text (required), OpenAI for images, speech and transcription, and ElevenLabs for speech (optional). The first article described in paragraph 4 is an exception. The User pays AI Providers directly, under their price lists. The Subscription price does not include these fees.
First article without an API Key. After confirming their email address and accepting the current version of these Terms, the User may generate one article on a self-created Account without an Anthropic API Key. The Provider then makes the Anthropic model calls needed for that article and for its scoring and revisions on its own key and at its own cost, within these limits:
one article per email address, also after the Account is deleted and a new one is created with the same address,
a limited number of model calls and a limited time from the first call,
a daily pool shared by all Users.
The article under paragraph 4 counts towards the article limit of the Plan. This option is free of charge and is not part of any Plan. The Provider may limit or switch it off, in particular when the daily pool or the budget set aside for it is used up. The User is then not entitled to a refund or compensation. Further articles require the User's API Key.
AI Providers apply their own terms and acceptable use policies, which the User accepts separately when creating an account with them. These terms may restrict the purpose of keys, for example to professional use. The User is responsible for complying with the terms of the AI Provider with whom they have contracted.
The API Key is stored only by the User's browser, in an encrypted cookie. With each request the browser sends it to the Provider's server, which decrypts the API Key solely for the duration of that request, passes it to the AI Provider and does not store it.
Accounts created by the Provider before self-service registration was available continue on individually agreed terms, including the use of the Provider's keys, unless the parties agree otherwise.
Outputs are generated automatically and may contain errors or outdated or inaccurate information. Scoring and fact-check features are supporting tools only. The User checks Outputs before publishing them.
4. Technical requirements
Using the App requires a device with internet access, a current version of Chrome, Edge, Firefox or Safari with JavaScript, cookies and local storage enabled, an email address and an API Key (except for the first article, section 3(4)). Dictation requires a microphone.
Output history, drafts and settings are stored in browser storage on the User's device, and API Keys in encrypted cookies of that browser. The Provider has no access to the history and drafts and makes no copies of them. Clearing browser data or changing devices means losing them, so it is worth exporting important Outputs to files.
Risks of using services by electronic means include interception of login data, malware on the User's device and phishing. The User protects their password and API Keys and does not use the App on untrusted devices.
5. Prices and payments
Plan prices are shown in the Price List and on the purchase screen as final prices, in Polish złoty or in euro, depending on the currency chosen at purchase. The Provider is exempt from VAT, so the price includes no VAT and is the amount payable.
Payments are processed by Stripe Payments Europe, Limited (Ireland). Available payment methods are shown in the payment form. Card data is processed only by Stripe.
The Subscription is paid in advance for each monthly billing period and renews automatically until the User cancels it (section 10). The fee for the next period is charged on its first day.
After each payment the User receives a payment confirmation by email from Stripe. On request made within 3 months after the end of the month in which the service was provided or payment received, the Provider issues a receipt.
If payment for the next period fails, the User is informed by email and the payment is retried. If the payment does not succeed within 7 days, access to the paid Plan is suspended and the Account works under the Free Plan rules (without granting the free article limit again) until a successful payment or the end of the Subscription.
Monthly limits renew on the first day of each calendar month, regardless of the day on which the billing period starts. Unused limits do not carry over to the next month.
With every announcement of a price reduction the Provider also states the lowest price from the 30 days before the reduction.
A Subscription can be ordered by persons whose billing address is in a European Union member state listed in the payment form.
A User with a Subscription may change to another paid Plan at any time in the Account settings. Before the User confirms the change, the Stripe form shows the amount payable or the date of the change. The change does not affect the currency of the Subscription or the dates of the following billing periods:
a change to a more expensive Plan takes effect immediately: for the rest of the current billing period the User pays the price difference, in proportion to the time left until the end of that period, and from the next period pays the price of the new Plan;
a change to a cheaper Plan takes effect from the start of the next billing period; until then the User keeps the current Plan;
from the change, the limits of the new Plan apply, and usage in the current calendar month counts towards them.
6. Conclusion of the contract
The Account agreement is concluded when the Account is created, after acceptance of these Terms. It is concluded for an indefinite period.
To order a Subscription the User: (a) chooses a Plan in the App, (b) reviews the summary (price, billing period, automatic renewal, how to cancel), (c) accepts these Terms, (d) if they are a Consumer or a sole trader with consumer rights, requests that performance begins before the withdrawal period ends (section 9(4)), (e) enters payment details in the Stripe form and confirms the order with a button that indicates an obligation to pay.
The Subscription contract is concluded when the payment is confirmed. Access to the Plan is granted without delay.
The Provider sends to the User's email address a confirmation of the contract together with these Terms, the information on the right of withdrawal with the model withdrawal form and a confirmation of the request in paragraph 2(d).
The contract is concluded in Polish or English, depending on the language version of these Terms accepted by the User.
7. Rules of use and content
The User uses the Service in accordance with the law, these Terms and good practice. Providing unlawful content is prohibited, as is using the Service to:
infringe third-party rights, including copyright, trade marks and personal rights;
create fake consumer reviews or ratings, fake endorsements or content that misleads about its origin or author;
impersonate other persons or institutions, including media, public authorities and election candidates;
generate or manipulate realistic intimate images of an identifiable person without their explicit consent, or content depicting child sexual abuse;
send unsolicited commercial communications;
circumvent the safeguards of the Service or AI Providers or breach AI Provider terms;
remove, alter or falsify marks indicating that content was generated by artificial intelligence, applied by the Service or AI Providers (metadata, watermarks), except removing a visible label that the User added;
enter third-party personal data without a legal basis, in particular special categories of data.
Marking AI content. The Service supports the transparency requirements of Article 50 of Regulation (EU) 2024/1689 (the AI Act): it marks Outputs in a machine-readable format wherever the file format or publishing channel allows it. Details are on the "AI Act and transparency" page (https://content-ai.net/en/ai-act/).
The User's obligations when publishing (Article 50(4) of the AI Act). A User who publishes Outputs assesses and performs the obligations of a deployer of an AI system; the App provides visible label switches for this purpose. In particular, the User:
discloses that an image or recording was generated or manipulated by AI if it resembles existing persons, objects, places or events and could falsely appear authentic;
discloses that a text published to inform the public on matters of public interest was generated by AI, unless it underwent human review or editorial control and a natural or legal person holds editorial responsibility for its publication;
tells listeners that a recording is read by a synthetic voice.
The User is responsible for publishing and using Outputs, including their legality and accuracy.
The Provider claims no rights to User Content or Outputs. The User grants the Provider a non-exclusive, royalty-free licence to store and process User Content solely to the extent necessary to provide the services, for the duration of use of the Service. The Provider does not guarantee that Outputs are protected by copyright or unique.
8. Reporting illegal content and moderation
The point of contact for Member State authorities, the European Commission and users for the purposes of Regulation (EU) 2022/2065 (Digital Services Act) is kontakt@content-ai.net. You can contact us in Polish and English.
Anyone can report content stored in the Service that they consider illegal. A notice should include: an explanation of why the content is illegal; information allowing the content to be located; the name and email address of the notifier (except for notices concerning child sexual abuse); a statement that the notice is made in good faith and is accurate and complete.
The Provider confirms receipt of the notice, processes it without undue delay and informs the notifier of the decision and the available redress.
The Provider does not routinely review Knowledge Base documents. It acts on notices, orders of authorities and its own knowledge of an infringement. AI Providers apply their own automated filters and may refuse to generate content.
If the Provider removes content, restricts access to it or suspends an Account, it gives the User a statement of reasons: what was done, on what basis, which facts were considered and how to appeal (complaint under section 11).
The Provider informs the competent authorities of any suspicion of a criminal offence involving a threat to the life or safety of persons.
9. Right of withdrawal (Consumers and sole traders with consumer rights)
A Consumer may withdraw from the Subscription contract within 14 days of its conclusion without giving any reason.
To withdraw, before the deadline, use the withdrawal function in Account settings, send a statement by email to kontakt@content-ai.net or by post to Wojewódzka 37A, 05-504 Złotokłos. The model withdrawal form may be used but is not obligatory. The Provider confirms receipt by email without delay.
The Provider reimburses payments without undue delay and no later than 14 days after receiving the statement, using the same means of payment unless the Consumer agrees otherwise, at no cost to the Consumer.
If the Consumer requested that performance begin before the withdrawal period ends, they pay an amount proportionate to the performance provided until withdrawal, calculated from the Subscription price for the number of days the Plan was available. The Provider deducts this amount from the reimbursement.
After withdrawal, access to the paid Plan ends and the Account works under the Free Plan rules (without granting the free article limit again).
10. Cancelling the Subscription, termination
The User can cancel the Subscription at any time in Account settings (Stripe payment portal). Cancellation takes effect at the end of the paid billing period; until then the Plan remains available. There is no refund for the unused part of the period, except in the cases in sections 9, 11 and paragraph 4.
The User can delete the Account at any time in Account settings or by email request. Deleting the Account ends the Subscription immediately; after the withdrawal period, without a refund for the unused part of the period. Deleting the Account also deletes Knowledge Base documents (section 14).
The Provider may terminate the Account agreement for important reasons: serious or repeated breach of section 7, acting to the detriment of the Service or other Users, an order of an authority. Termination is made by email with a statement of reasons and 14 days' notice, and in serious cases (for example content under section 7(1)(4)) with immediate effect.
If the Provider stops providing the services for reasons not attributable to the User, it refunds the price for the unused part of the billing period.
11. Complaints and conformity of the service
The Provider is liable to Consumers for the conformity of the digital service with the contract under the Polish Consumer Rights Act.
Complaints can be sent by email (kontakt@content-ai.net) or post (Wojewódzka 37A, 05-504 Złotokłos). Please describe the problem, when it occurred and how you would like it resolved.
The Provider replies to a complaint within 14 days of receiving it.
If the service does not conform with the contract, the Consumer may demand that it be brought into conformity and, where this is impossible, has not happened within a reasonable time or the lack of conformity is significant, a price reduction or withdrawal from the contract, under the statutory rules.
Consumers may use out-of-court dispute resolution, including consumer ombudsmen, the Trade Inspection and, for cross-border disputes in the EU, the European Consumer Centre. Information: https://prawakonsumenta.uokik.gov.pl
Business Users who are not sole traders with consumer rights submit complaints in the same way; paragraphs 1 and 4 do not apply to them.
12. Changes to the service, prices and Terms
The Provider may change App features for valid reasons: changes in law, changes in AI Provider services, security, feature development. Changes are free of charge for the User. If a change materially and negatively affects a Consumer's access to or use of the service, the Provider informs them in advance on a durable medium and the Consumer may terminate the contract under the Consumer Rights Act.
The Provider may change these Terms or prices for important reasons: changes in law, a decision or judgment of an authority, changes in prices or terms of AI Providers, payment or hosting providers, changes in the scope of services, preventing abuse. The Provider informs Users by email at least 30 days before the change takes effect.
A new price applies from the first billing period starting after the change takes effect. A User who does not accept the change may cancel the Subscription before that date at no cost.
Contracts concluded before the change remain subject to the previous Terms until the end of the current billing period, unless the User accepts the change earlier.
13. Liability
The Provider aims for uninterrupted operation of the Service but may interrupt it for maintenance, where possible outside 8:00-20:00 Polish time. Availability of AI Provider services depends on them.
Towards Consumers, the Provider's liability is governed by law and is not limited where the law does not allow it.
Towards Users who are neither Consumers nor sole traders with consumer rights, the Provider's liability is limited to the amount paid by the User in the last 3 months and excludes lost profits; the limitation does not apply to damage caused intentionally.
The Provider is not liable for the content of Outputs published by the User, for decisions made on their basis or for the consequences of the User breaching AI Provider terms.
14. Personal data
The Privacy Policy describes how personal data is processed.
If the User enters personal data for which they are the controller (for example in Knowledge Base documents), the Provider processes it on the User's behalf under the data processing agreement (Annex 1), concluded together with acceptance of these Terms.
After an Account is deleted, the Provider deletes Knowledge Base documents and Account data, except data it must keep under the law (for example sales records) or to establish or defend claims, and the hash of the email address needed for the limit in section 3(4)(1), for the periods stated in the Privacy Policy.
15. Final provisions
These contracts are governed by Polish law. This choice of law does not deprive a Consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence.
Disputes with Consumers are resolved by courts competent under general rules. Disputes with other Users are resolved by the court competent for the Provider's place of residence.
These Terms, version 2026-10-v3 of 14 October 2026, apply from the day they are made available in the Service.
